2. Acceptance of Terms

By using our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.

3. Service Agreements

3.1 Project Scope

All projects will be defined through a detailed proposal or statement of work that outlines:

  • Project deliverables and specifications
  • Timeline and milestones
  • Pricing and payment terms

3.2 Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete information
  • Timely feedback and approvals

  • Making timely payments as per agreed terms

4. Payment Terms

4.1 Pricing

All prices are quoted in Indian Rupees (INR) unless otherwise specified. Prices are subject to change, but quoted prices for accepted proposals remain valid for the duration of the project.

4.2 Payment Schedule

Unless otherwise agreed in writing, our standard payment terms are:

  • 50% advance payment to commence work
  • 50% upon project completion and before final delivery

For larger projects, milestone-based payments may be arranged.

4.3 Late Payments

Late payments may result in project suspension and may incur additional charges. We reserve the right to withhold deliverables until full payment is received.

5. Intellectual Property Rights

5.1 Client-Owned Content

You retain all rights to content, images, and materials you provide to us. By providing these materials, you grant us a license to use them for the purpose of completing your project.

5.2 Deliverables

Upon full payment, you will own the final deliverables as specified in the project agreement. However, we retain the right to:

  • Display the work in our portfolio
  • Use the project as a case study
  • Reference the work for promotional purposes

5.3 Third-Party Assets

Any third-party assets (fonts, stock images, plugins, etc.) used in your project may require separate licensing. We will inform you of any such requirements.

6. Revisions and Changes

Each project includes a specified number of revision rounds as outlined in the project proposal. Additional revisions beyond the agreed scope may incur extra charges. Major scope changes will require a new proposal and additional payment.

7. Project Timeline

We strive to meet all agreed deadlines. However, timelines are estimates and may be affected by:

  • Delayed client feedback or approvals
  • Changes in project scope
  • Technical challenges or third-party dependencies
  • Force majeure events

8. Cancellation and Refunds

8.1 Client Cancellation

If you wish to cancel a project:

  • Work completed up to the cancellation date will be billed
  • Advance payments are non-refundable but will be credited toward completed work
  • You will receive deliverables for work completed and paid for

8.2 Our Right to Terminate

We reserve the right to terminate a project if:

  • Payment terms are not met
  • Client fails to provide necessary materials or feedback
  • Client behavior is abusive or unprofessional
  • Project requirements violate laws or our ethical standards

9. Warranties and Disclaimers

9.1 Our Commitment

We commit to delivering professional, high-quality work that meets the specifications outlined in your project agreement.

9.2 Limitations

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

  • Specific business results or revenue increases
  • Search engine rankings or traffic volumes
  • Compatibility with all future technologies or platforms
  • Uninterrupted or error-free operation of delivered products

10. Limitation of Liability

To the maximum extent permitted by law, PixelBazaar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Confidentiality

We respect the confidentiality of your business information and will not disclose sensitive information to third parties without your consent, except as required by law or as necessary to complete your project.

12. Support and Maintenance

Post-launch support and maintenance services are available separately. Unless explicitly included in your project agreement, ongoing support, updates, and maintenance require a separate agreement.

13. Third-Party Services

We may recommend or integrate third-party services (hosting, payment gateways, analytics, etc.). You are responsible for complying with the terms and conditions of these third-party services.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
